01 What is the TCPA?
The Telephone Consumer Protection Act (TCPA) is a US federal law that restricts how businesses can contact people by phone. It was originally designed to curb robocalls and prerecorded-voice spam, but in February 2024 the FCC ruled that AI-generated voices constitute an "artificial or prerecorded voice" under the TCPA — putting AI calling platforms like Dialsdone under the same rules as traditional robocallers.
Key rules under the TCPA:
- Calls to mobile phones using an automated system require prior express written consent from the recipient.
- Calls must not be made before 8:00 AM or after 9:00 PM local time at the recipient's location.
- Numbers listed on the National Do-Not-Call Registry must not be called without a lawful exemption.
- Opt-out requests must be honored immediately and permanently.
02 B2B vs. B2C — Why It Matters
Dialsdone is a B2B-only platform. Your TCPA risk profile is very different depending on who you're calling:

- Calling business phone numbers
- Calling work direct lines
- Calling numbers sourced from LinkedIn, Apollo, or ZoomInfo
- Calling other businesses and professionals
✗ B2C Calls (Prohibited)
- Calling personal mobile numbers
- Calling residential landlines
- Calling property owners (FSBOs, etc.)
- Any consumer-facing calling
Dialsdone's Terms of Service explicitly prohibit B2C calling. Uploading consumer lists violates your agreement and may result in immediate account termination.
03 What Dialsdone Provides
Dialsdone has built the following compliance infrastructure into the platform:
- Call-time restrictions — The AI only dials during the calling hours you configure. Set your window to stay within the 8am–9pm local time rule.
- Timezone enforcement — Calling hours are applied against the timezone you set in the dashboard, so calls don't go out at the wrong local time.
- In-call opt-out detection — If a prospect says "stop calling," "remove me," or similar opt-out language during a call, the AI detects it, ends the call, and logs the opt-out so that lead is never redialed.
- A B2B-only policy — The platform is built and licensed for business-to-business outbound only; B2C use is prohibited under the Terms of Service (see Section 2 above).
- Call recording disclosure support — All calls are recorded. Many US states require that all parties be notified a call is being recorded. You are responsible for including a recording disclosure in your agent's script where required by applicable law. DialsDone provides the infrastructure; the disclosure obligation is yours.
What Dialsdone does not provide: National or state Do-Not-Call Registry scrubbing, consent logging, or legal advice. These remain the Customer's responsibility. See Section 4 below.
04 Your Responsibilities
As the operator of your campaigns, you are the data controller and the caller of record. TCPA liability attaches to the business initiating the calls — not the software platform. Non-compliance can result in statutory damages of $500–$1,500 per call. You are solely responsible for:
- DNC scrubbing — Scrub your prospect list against the National DNC Registry and any applicable state registries before uploading to Dialsdone.
- Consent for mobile numbers — If your list includes mobile numbers, you must have prior express written consent from each recipient before calling.
- Consent records — Maintain records of how and when consent was obtained. If a TCPA claim is filed, the burden of proof falls on you.
- AI disclosure in scripts — Some states and jurisdictions require you to disclose at the start of a call that the caller is an AI or automated system. Configure this in your script.
- State-specific rules — Florida, California, Texas, and other states have telemarketing laws stricter than the federal TCPA. You are responsible for compliance in every state where your prospects are located.
- Honoring opt-outs — Maintain your own internal DNC list and ensure opted-out numbers are never re-uploaded in future campaigns.
05 Pre-Campaign Checklist
Before launching any campaign on Dialsdone, work through this checklist:

Scrub your list against the National DNC Registry — visit donotcall.gov or use a scrubbing service before uploading your CSV.
Remove all personal/consumer numbers — B2C calling is prohibited. Your list should contain business contacts only.
Verify mobile number consent — If calling mobile numbers, confirm you have prior express written consent on file for each recipient.
Set calling hours to 8am–9pm local time — Configure this in your Dialsdone dashboard under AI Calling Hours.
Include AI disclosure in your script — Add a line at the start of your script disclosing that the call is AI-assisted where required by local law.
Configure opt-out handling — Ensure your script acknowledges opt-out requests and that opted-out contacts are removed from future uploads.
Check state-specific rules — If calling into Florida, California, or Texas, review those states' additional telemarketing requirements.
Keep consent records — Maintain documentation of how prospect data was obtained and any consents collected.
